Filed in August 2024 by Sherri Crichton, the widow of ER creator Michael Crichton, the suit alleges that Max’s latest medical drama bears too much resemblance to ER. It names Noah Wyle, the actor who played Dr. Robby (and previously Dr. Carter in ER), Scott Gemmill, the creator of The Pitt, executive producer John Wells, and Warner Bros Television for breach of contract, among other charges. Yet, fans of the show find the lawsuit’s claim that “The Pitt is ER” to be far-fetched.

People watching “The Pitt” often find it puzzling that a lawsuit has been filed by the estate of Michael Crichton, the creator of “ER”, because while both shows belong to the medical drama genre, their formats are significantly distinct.

Reddit users responding to the lawsuit find the idea that “The Pitt” is simply an ER reboot to be a far-fetched claim. One user even called it “ridiculously weak.” The suit characterizes “The Pitt” as being essentially the same as the proposed ER reboot, featuring the original executive producer, writer, actor, production companies, studio, and network.

Fans argue that the series “The Pitt” doesn’t seem to align with the ER universe, and while both star John Wyle, it’s not a substantial link. One viewer even remarked, “The Pitt isn’t ER; The Pitt is 24,” emphasizing the distinct real-time format of The Pitt, where each episode represents an hour of a 15-hour shift, which sets it apart from ER. Some have criticized the lawsuit as being “unnecessary”, “greedy”, “distasteful”, and “a cash grab”.

According to Variety, Wyle confessed that plans were underway for a reboot of ER featuring John Carter, but discussions between Warner Bros. Television and Sherri Crichton broke down. Despite this setback, Max remained intrigued, leading them to revise the idea. However, the lawsuit has left Wyle feeling “deeply saddened and disheartened,” expressing that “on the 30th anniversary of ER, I’ve never felt less enthusiastic about celebrating that accomplishment than I do this year.

Regardless of the ongoing lawsuit, Max has already given approval for the second season of The Pitt, set to premiere in January 2026.
