Superman Movie Lawsuit Dismissed, Warner Bros. Discovery Gives Statement

The lawsuit regarding the release of the Superman DCU movie has been dismissed.

Previously, the estate of Joseph Shuster, one of the creators of the iconic Superman character (alongside Jerry Siegel), initiated a lawsuit against Warner Bros. Discovery and DC Comics with the aim of preventing the release of James Gunn’s upcoming movie in certain regions.

According to The Hollywood Reporter, U.S. District Judge Jesse Furman ruled that he lacked jurisdiction over the lawsuit on April 24, 2025, as the copyright infringement allegations were based on foreign laws.

What did Warner Bros. Discovery say about the dismissed Superman lawsuit?

According to a representative from Warner Bros. Discovery, it has long been established that the rights to Superman belong to DC.

The court case was initiated by Warren Peary, Shuster’s nephew. He asserted that copyright laws were violated in countries like the U.K., Australia, Canada, and Ireland, among others. His argument was that Warner Bros. Discovery (WBD) had forfeited its international rights to Superman long ago but has been using them illegally without providing due compensation.

In the recent decision made on Thursday, the court dismissed Peary’s claims stating that the lawsuit in question does not involve a potential violation of U.S. law. According to Furman, these ‘infringement allegations’ are based on foreign laws rather than American ones.

In U.S. copyright regulations, Jerry Shuster might have been entitled to reacquire his domestic rights for Superman due to a provision in intellectual property law which grants authors the ability to regain control of their works after a specified duration. However, his sister and brother struck an agreement with DC in 1992 that nullified this right, in return for an annual payment of $25,000. This decision was later validated by a federal appellate court.

Superman will be released in United States theaters on July 11, 2025.
