Nintendo take action against YouTuber for showing viewers an emulator

As someone who has spent countless hours immersed in the magical world of Nintendo, I find myself torn between my admiration for the incredible games they’ve created and my frustration with their strict policies regarding emulators.

As a devoted gamer, I’ve always found the connection between me and Nintendo to be a bit rocky. Lately, the go-to Switch emulator we all relied on was taken down due to Nintendo’s orders, and now, it seems a fellow content creator has been hit with a copyright warning, just for demonstrating a Switch emulator to their audience. Quite surprising, isn’t it?

Nintendo continue waging war on emulators

Retro Games Corporation boasts approximately 550,000 subscribers on its YouTube channel, where it frequently shares updates on the newest Nintendo emulators. However, in a recent post, he disclosed that one of his videos about a Wii U emulator had been removed.

In the future, he plans to alter his video content in order to steer clear of any potential repercussions from Nintendo, for instance, he will refrain from displaying Nintendo games during his videos.

This YouTube content creator presents a strong point that undermines the initial copyright claim. Since the Wii U Store is shut down, Nintendo isn’t experiencing any direct harm from this specific emulator.

I am still considering a counter claim under fair use, as the video was for educational use, transformative in nature, and had no effect on the market — it was a demonstration of a console no longer for sale (even the Wii U eShop is closed, so the company itself has no means of earning revenue from Wii U sales).

But however strong his arguments, this is his second strike, so he needs to stop, or his channel will be deleted.

Do you think Nintendo’s reaction is fair?
