As a seasoned gamer with decades of experience under my belt, I find myself torn between two perspectives when it comes to the ongoing saga of EveryGameGuru vs Nintendo. On one hand, I understand Nintendo’s need to protect their intellectual property and ensure a fair market for their games. On the other, I can sympathize with a fellow gaming enthusiast who just wants to share his passion with the world.
Jesse Keighin, more commonly recognized as EveryGameGuru, finds himself in a legal dispute with the gaming giant, Nintendo, due to his persistent broadcasting of unpublished Switch video games.
Nintendo takes serious action regarding emulator use, copyright violations, and leaks. It is said that they have already issued numerous takedown notices and cease-and-desist orders against Keighin for streaming games even up to three weeks before their release. However, the streamer has thus far chosen to disregard these actions.
As a gamer, I find myself in an unfortunate situation, as Nintendo has accused me of something I never intended – promoting and profiting from the downloading of unauthorized copies of unreleased games. Specifically, they’ve pointed out my recent actions regarding “Mario & Luigi: Brothership.” Despite their requests for me to remove the content, I streamed the game nearly three weeks before its official release.
Nevertheless, Keighin may find it difficult to dismiss a lawsuit filed by Nintendo, as it could potentially mark the end of his streaming career. Reportedly, Nintendo is seeking $150,000 in damages for each infringement, which amounts to over $7.5 million in total.
In your own words, how would you express the following: Are Nintendo being excessively rigorous, or are they justified in taking legal action against EveryGameGuru?
