Nintendo is suing Genki over Switch 2 leaks

Previously this year, with excitement mounting for the forthcoming Switch 2, accessory producer Genki made a stir by unveiling what appeared to be a prototype of the upcoming Nintendo console at CES. They showcased their upcoming accessories intended for the system. However, Nintendo has since filed a lawsuit against Genki, alleging trademark violation and misrepresentation.

On May 2nd, as reported by The Game Post, Nintendo took legal action against Genki at the U.S. District Court for the Central District of California. In this lawsuit, Nintendo accused Genki of falsely claiming they had unauthorized access to the upcoming Switch 2 console ahead of its official unveiling by Nintendo. Furthermore, Nintendo asserted that Genki misled consumers by using official Switch branding in marketing their Switch 2 accessories.

The lawsuit further points out that Genki was present at CES 2025, where they showcased 3D printed models of the Switch 2 at their booth. These mockups were available for visitors to examine and touch. Nintendo alleges that Edward Tsai, Genki’s leader, informed CES attendees that his company possessed a genuine Switch 2 console, which they utilized in designing their accessories.

Over the weekend, Genki issued a response following Nintendo’s lawsuit. They stated that they are collaborating with their legal team to deliver a careful reply, and they continue to uphold the quality and originality of their products.

Meanwhile, the court case outcome is pending, Genki intends to show up at PAX East happening this week in Boston, Massachusetts. The Switch 2, which Nintendo will officially launch, is scheduled for release on June 5 of the coming month.
