The song was accused of borrowing melodies from two older disco tunes, but these claims were proven unfounded as a U.S judge ruled in favor of Dua Lipa, drawing comparisons to Ed Sheeran’s successful legal victory in 2023.

Russell Brown and Sandy Linzer in 2022, asserted that her smash hit “Levitating” from 2020 bore striking resemblance to two disco tracks – “Wiggle and Giggle All Night” (1979) and “Don Diablo” (1980). However, it seems the jury found otherwise, ruling in Dua Lipa’s favor.
In her decision, U.S. District Judge Katherine Polk Failla stated that the disputed musical elements in question fall under overly generic copyright protection. She highlighted the fact that similar melodies have appeared in works by Mozart, Rossini, and the Bee Gees’ “Stayin’ Alive”, as well as in Ed Sheeran’s 2023 copyright case. This ruling implies that no artist can exclusively own common musical phrases.
As a gamer, I recently came across an interesting piece of news about the music industry. Brown and Linzer asserted that the opening melody from Dua Lipa’s song “Levitating” is similar to some compositions they created. However, Judge Failla made it clear that common musical phrases cannot be copyrighted. Yet, Brown and Linzer’s legal team has expressed their intention to appeal this decision. On two occasions, Lipa has triumphantly defended her hit song “Levitating” in court. In the year 2023, a different legal dispute initiated by the Florida reggae group Artikal Sound System was terminated. This happened when they couldn’t provide sufficient evidence that Lipa had access to their 2015 track, titled “Live Your Life.
Despite her recent victories, Lipa remains entangled in a legal dispute with musician Bosko Kante. The lawsuit alleges that Kante’s talk box recording was incorporated into the remixes of her song “Levitating” without his consent. He is demanding compensation amounting to at least $2 million as damages.
