1) Dhanush initiated a copyright case against Nayanthara following her claim of incorporating scenes from their film “Naanum Rowdy Dhaan” in her documentary. Notably, the Madras High Court has turned down Netflix India’s request to dismiss a lawsuit brought by Dhanush’s production company, Wunderbar Films.
Based on Live Law’s report, Netflix contended that the court didn’t have authority because its office is located in Mumbai. They asserted that the plaintiff failed to adhere to the mandatory pre-lawsuit mediation procedure. Furthermore, they noted that a photo from the film set was shared in 2020, but no action was taken until after the documentary’s release.
As a die-hard fan, I must say, it’s been brought to light that the captivating footage in question is actually owned by the prolific producer, Dhanush. It’s clear as day that the use of this footage without his explicit consent constitutes copyright infringement. To make matters worse, after the trailer was unveiled, a stern warning was issued to Netflix, but they chose to overlook it. However, only when the documentary was released did the full extent of the usage become apparent, prompting the filing of this suit.
The report continued by explaining that the court acknowledged Dhanush had previously been granted permission to sue Netflix in the Madras High Court. It decided in support of Wunderbar Films and permitted the legal action to move forward. Justice Abdul Quddhose has set a court hearing for February 5, 2025, to consider an application for a temporary restraining order.
Previously, Dhanush’s legal representative explained that both his firm and Nayanthara had agreed to assign him the copyright for every element related to the movie, including all characters and costumes worn by Nayanthara in the film. He further clarified that this agreement allows the lawsuit to proceed, as it has a valid reason for being heard in court.
In November, Dhanush’s production company, Wunderbar Films, initiated a legal action against actors Nayanthara and Vignesh Shivan, as well as Rowdy Pictures. The lawsuit alleges that they incorporated footage from the film Naanum Rowdy Dhaan in the Netflix docudrama titled “Nayanthara: Beyond the Fairytale.” Furthermore, Wunderbar Films sought the High Court’s approval to file a suit against Los Gatos Production Services India, which is Netflix’s content investment entity based in India.
