In the early part of this year, Apple suffered a legal setback when a US Judge concluded that Apple representatives had given false testimony about an injunction regarding charging fees for third-party payment options within apps on iOS. This decision was accompanied by a court order prohibiting Apple from banning third-party app payment methods. In response, Apple has submitted an appeal to contest this ruling, with the aim of maintaining control over third-party payments within its iOS platform.
Apple’s appeal was submitted to the U.S. Court of Appeals for the Ninth Circuit, located in Northern California, as observed by The Verge. This appeal is intended to reverse a decision made by Judge Yvonne Gonzales Rogers in April 2025. In her ruling, groups such as Epic Games (with whom they have frequently clashed on these issues) were granted the ability to introduce an app version of the Epic Games Store on iOS. This would pave the way for Fortnite’s return to the platform within the U.S.
It’s clear that Apple would prefer not to allow Epic Games to reinstate Fortnite on iOS following its banishment, but given their current predicament in court and the limitations they face due to the Digital Markets Act in Europe, where Fortnite’s re-launch through Epic Games Store is now possible, it seems increasingly difficult for Apple to prevent this from happening.
