In a recent court decision, it was determined that Judge Rogers found Apple and one of its executives guilty of providing false testimony during their legal dispute with Epic Games. This falsehood revolved around the charges that Apple imposes on businesses for transactions made within both the App Store and the developers’ own links.
Today, April 30th, an intriguing development unfolded in the Apple vs Epic Games case. Judge Yvonne Gonzales Rogers stated in a court document that Apple deliberately disregarded the Injunction, intentionally created another excessively high price and imposed new restrictions, thereby intentionally violating the injunction.
According to Rogers, Apple Vice President of Finance Alex Roman misled the court regarding the timing when Apple began charging a 27% fee for transactions on its platform made by developers who directed users to use an external link (an alternative payment method) instead of Apple’s App Store purchases, which incur a 30% fee.
Back in 2024, as a gamer myself, I found out that according to Rogers’ ruling, there were supposed to be no fees for off-app purchases. However, to my dismay, Apple decided otherwise and started charging these fees. What really irked me was when Rogers claimed that Roman had misled the court about when Apple made this decision, and neither Apple nor its legal team corrected his statements.
According to the court document, Philip Schiller recommended that Apple obey the injunction, but Tim Cook disregarded this counsel and paid heed to his financial advisors instead. In a subsequent analysis, Rogers states that Cook made an unwise decision.
In a sharp critique, Rogers pointed out that Apple’s courtroom claims contradicted its internal records. These records suggest that not only was Apple aware of its actions, but also deliberately opted for the least competitive options at each step.
1) The court recently mandated that Apple should no longer limit its platform with regulations that prevent users from accessing and being aware of competitive options. Concurrently, Epic Games stated they would reintroduce Fortnite to the American App Store, only if Apple applies these tariff-free rules globally.
