Justin Baldoni has countered Blake Lively’s attempt to throw out his $400 million defamation lawsuit, which was submitted on April 3 at a federal court in New York. Lively’s initial motion, filed on March 20, aimed for dismissal under the California Civil Code Section 47.1, a provision that shields individuals from being sued when they publicly discuss sexual harassment. The case presented states that Lively’s motion ought to be refused since her initial lawsuit includes particular defamation allegations. As stated by Baldoni’s lawyers, Lively is said to have tried to force Baldoni and his studio, Wayfarer Studios, into granting her complete creative control over the film. When her strategy supposedly failed, she reportedly made harmful public statements. Furthermore, Baldoni’s legal team contends that the court should not grant Lively attorney fees or compensation for damages, even if they rule in favor of dismissal.
Lawyer for Baldoni, Bryan Freedman, explained that Lively’s request aims to evade accountability by invoking legal immunity. He contends that in order for her to qualify under Section 47.1, the court must determine three conditions: first, she acted individually and without ill-intent; second, she had a sound basis for her allegations; and third, her actions were reasonable.
In a declaration, Freedman asserted that Ms. Lively, along with her influential Hollywood friends, can’t obstruct his clients from utilizing their constitutional privilege to seek legal redress in court to disprove and retract her untrue and damaging allegations against them.
