As a dedicated follower of Tamil cinema and someone who has witnessed the rise of these two powerhouse artists, I find myself torn between the legalities and the camaraderie that seems to be at stake here. On one hand, I understand Dhanush’s standpoint as a producer, wanting due credit and protection for his work. Yet, on the other hand, I can’t help but feel a pang of nostalgia when I recall the dynamic duo they once formed on screen in Naanum Rowdy Dhaan.
Actor Dhanush recently initiated a civil lawsuit against actress Nayanthara and her husband Vignesh Shivan over a brief clip from their movie “Naanum Rowdy Dhaan” being used in Nayanthara’s Netflix documentary, titled “Nayanthara: Beyond the Fairytale.” Dhanush contends that the footage was utilized without his approval. Subsequently, attorneys for Nayanthara have issued a formal response to Dhanush’s legal notice.
As an ardent admirer, I’d like to share my take on a recent conversation I’ve imagined with Hindustan Times. In this imaginary chat, I, as the lawyer, would assert that no copyright laws were breached in the utilization of visuals. I’d also clarify our position regarding the legal matter at hand. In my viewpoint, the footage used in the documentary is not from the film’s backstage, but rather sourced from a personal archive. This, I believe, does not equate to copyright infringement or violation.
According to our statement, there’s no breach or violation since what we used in the documentary series isn’t from backstage footage of the movie. Instead, it comes from a personal collection, so it doesn’t constitute an infringement.
The upcoming court hearing for the case involving Dhanush and Nayanthara could potentially be held at the Madras High Court on the 2nd of December.
According to The Hindu’s report, Dhanush’s film production company, Wunderbar Films Private Limited, has filed a lawsuit against actress Nayanthara, her husband Vignesh Shivan, and their production company. The complaint alleges that visuals from another production (NRD) were utilized in Nayanthara’s documentary without obtaining prior permission or notification from Dhanush’s production house.
Additionally, Dhanush’s organization requested authorization from the High Court to initiate a lawsuit against Los Gatos Production Services India LLP – the entity that oversees Netflix’s content investments throughout and within India.
The court reviewed arguments from both sides. It granted permission, noting that a significant part of the dispute occurred under its jurisdiction. Nayanthara is now required to respond to this legal case in the next hearing.
Since November 18, Nayanthara’s movie “Beyond the Fairytale” has been streaming on Netflix. Prior to its premiere, the actress penned a firm letter to Dhanush, following his decision not to grant a No Objection Certificate (NOC) for incorporating film clips from their production titled NRD in her movie.
