As a researcher who has spent countless hours delving into the intricate world of intellectual property law and its applications within the rapidly evolving crypto industry, I find myself constantly amazed at the number of trademark disputes that arise. It’s like watching a game of Whack-a-Mole; just when you think you’ve seen it all, another one pops up!
Once more, software development giant Oracle Corporation has initiated a lawsuit against Crypto Oracle LLC and its founder Louis Kerner. The allegations include breaching a prior agreement and encroaching on Oracle’s trademark. This legal action was submitted to a federal court in California on the 25th of November. Tensions between the two parties date back to 2019, when Oracle Corporation first brought charges against Crypto Oracle, asserting that they had improperly used Oracle’s trademark to advertise cryptocurrency services under the “Crypto Oracle” label.
Despite them reaching a private agreement in their dispute, a court ruling has imposed a permanent ban on Crypto Oracle, preventing them from employing the “Crypto Oracle” title or any variant of the Oracle trademark.
Despite a 2020 court injunction, Oracle asserts in its latest submission that Crypto Oracle has resumed using the “Crypto Oracle” name and logo. The software company alleges that this action violates the terms of their settlement agreement, as Crypto Oracle has persisted in employing the disputed name, retaining the domain, and organizing events under the “Crypto Oracle Collective” label, all of which are said to be a breach of the agreement.
Consequently, Oracle aims to obtain financial compensation, statutory fines, as well as the deletion or relocation of domains and trademarks linked to the name “Crypto Oracle.
Currently, there’s no official response from Crypto Oracle regarding the accusations, and it’s unknown who, if anyone, is representing them in a legal capacity.
Trademark Disputes in the Crypto Space
The legal dispute involving trademarks between Oracle Corporation and Crypto Oracle is not the first in the crypto industry, as there are many such cases. A similar case happened in 2023 when NanoLabs sued Coinbase for trademark infringement over its Nano Bitcoin and Ether futures contracts. Also, in 2022, Dfinity Foundation filed a lawsuit against Meta, accusing it of trademark infringement over its infinity logo.
To add on, Phillip Banks, the mastermind behind the widely recognized meme coin “Just a Chill Guy,” has declared his intention to safeguard his popular character with copyright laws. Banks made this announcement on X and clarified that the character is now legally protected. He also mentioned he will start removing content that exploits the meme for financial gain. The “Chill Guy” meme, initially circulated towards the end of 2023, garnered massive attention as it became the symbol for $CHILLGUY, playing a significant role in the token’s quick rise to popularity.
In the world of cryptocurrency, the high number of trademark disputes suggests that intellectual property laws are intricate and challenging to navigate. Here, a strong brand identity can be crucial for earning consumer confidence and market visibility.
As a researcher in this dynamic field, I strongly advocate for crypto companies, particularly startups, to proactively safeguard their distinctive identities. This can be achieved by registering trademarks for their brands and logos, securing domain names that align with their company identity, and obtaining copyrights for original works. By taking these steps early, we can effectively shield ourselves from potential future conflicts and maintain the integrity of our unique creations in this rapidly expanding industry.
It’s wise for startups to meticulously check that their chosen names, symbols, and taglines are not similar to those already in use (trademarked). This helps to minimize potential disputes over copyright infringement. Having a unique and distinctive brand identity lessens the likelihood of such claims.
